When you buy a property, you buy any latent defects. This is why it's important to properly inspect a property before making an offer to purchase.

  • Buyers must know their rights and what the risks are when it comes to buying a house with latent defects.
  • Latent defects can be a risk and you may not have a claim against your seller, unless your seller hid the defects.
  • Take the precaution of hiring a home inspection service to confirm you are not buying a house with defects.
  • If you are a buyer whose seller hid a defect, you can make a claim against the seller within three years from when you discover the hidden defect.
